HC asks trial courts in-charge to consider staffer's transfer

Justice Suresh Kait asked District and Sessions Judge R K Gauba to reconsider his decision to transfer Sunil Kumar Gupta from Saket Court to Poor House in Kingsway Camp.

Justice Kait passed the order after the counsel for the district and sessions judge informed the court that Gupta's representation would be considered.

Sunil Kumar Gupta, a senior assistance posted at Saket court complex in South Delhi, in his petition filed through counsel R K Saini, pleaded that he has been suffering from hypertension since 2008 and submitted his medical records from various hospitals, including AIIMS, to substantiate it.

On July 1 last year, Gauba had transferred him from Saket court complex to the court of an additional sessions judge as reader but within days after taking up the new assignment, his condition began worsening, leading to heavy perspiration.

Considering his deteriorating conditions, the judge transferred him back to an administrative office in Saket court complex, but few days after, District Judge Gauba again transferred him to the Poor House at Kingsway Camp in North Delhi, meant for adjudication of issues related to beggars.

Gupta's counsel argued that as per the rules, his client could be attached only to the court room of an additional district and sessions judge or be posted in an administrative office of the court complex and not with any magistrate.

The lawyer also submitted that Poor House is also 30 km from Gupta's residence and argued that Gauba's decision, ignoring his medical conditions, would force his client to leave the job.
