The court also issued notice to DPS, Ghaziabad, Vasundhara and asked it to file it's counter affidavit in the case.
The bench comprising Chief Justice D B Bhosale and Justice Suneet Kumar passed the above order in a Public Interest Litigation (PIL) filed by the Ghaziabad Parents Association through its member Neeraj Bhatnagar.
In the petition it was alleged that DPS, Ghaziabad, Vasundhara, in last three years, raised tuition fees each year though the CBSE rules prohibit fees hike each year.
Petitioner had also alleged that the trust which runs the school also transferred income from fees to other trusts in violation of the CBSE rules though income from fees can only be used for maintenance of the school.
Petitioner had prayed that the accounts of the DPS should be audited for having violated the relevant rules and to treat the unauthorised fee realised from students as capitation fee' and recover the same from the school by way of fine and return the same to students who come forward to claim the same.
