HC declines to transfer case relating to suicide of DSP to CBI

The Madras High court today declined to transfer the probe relating to alleged suicide of DSP Vishnu Priya to CBI from the CB-CID police.
Vishnu Priya who was the DSP, Tiruchengode in Namakkal district and Investigating Officer in the sensational murder case of Dalit engineering graduate V Gokulraj, was found hanging in her residence-cum-office complex on September 18.
Justice R Subbaiah, rejecting the plea of M Ravi, father of the DSP to transfer the probe to CBI, said that "on a careful perusal of the entire status report and on examination of the materials placed on record before this court, I have satisfactorily come to the conclusion that the probe is going in a proper and right direction and there is no infirmity in the said investigation."
CB-CID had examined several persons, including SP of Namakkal Senthilkumar and K Maheswari, DSP of Keezhakarai, and Aravakurichi DSP Geethanjali and others and also collected various material documents including suicide note, medical report, details of telephonic conversation made by Vihsnupriya on her mobile phone, the judge said.
P Wilson, counsel for the petitioner, submitted that CB-CID being a wing of the state government, the investigation may not be fair and proper.
Public Prosecutor Shanmugavelayudham, who opposed the arguments, submitted that in order to conduct a proper and fair investigation, the case has been entrusted to CB-CID which is an independent agency and absolutely having no nexus with local police.
He submitted that the investigation is going in the right direction and there was no influence from any quarter on the investigating officers.

He contended the DSP was found dead and the state government is having more concern than the petitioner to discover the real fact behind her death and render substantial justice to the relatives of the officer.
The judge, who refused to transfer the probe to CBI said in his order that "taking note of the fact that CB-CID has been conducting the investigation in a proper and considered manner, I am of the view that there is no need to entrust the same to any other investigation agency and the allegations made by the petitioner are without any prima facie material".
"No grounds are made out by the petitioner of warranting transfer of the probe to CBI and the prayer sought for by the petitioner is hereby rejected. The petition is dismissed.", the judge said.
