A division bench headed by Chief Justice Vikramajit Sen dismissed the petition after petitioner P Subramanya, an advocate, withdrew it subsequent to the government advocate Veeranna submitting that they had complied with the necessary rules in the appointment of the anti-corruption watchdog.

The petitioner had contended that Majage's appointment was made without following the consultation process defined in the Karnataka Lokayukta Act and not effectively consulting all the constitutional functionaries as interpreted by the High Court in its April 3, 2012 order annulling the appointment of another Upalokayukta, Chandrashekaraiah.

He had also claimed that the Chief Minister did not circulate the name of the former judge to other constitutional functionaries
