The Madras High Court today directed a petitioner to implead those schools which are neither teaching nor facilitating their students to respect the national anthem on a daily basis as alleged by him.
A Division Bench, comprising Justice T.S. Sivagnanam and Justice K. Ravichandra Baabu, before which the petition filed by N. Selvathirumal came up, adjourned the matter for further hearing after two weeks.
According to the petitioner, some privately- managed schools are neither teaching nor facilitating their students to respect the national anthem on a daily basis by "playing/singing the national anthem."
The petitioner submitted that central government schools such as Kendriya Vidyalayas and all state government schools are doing it daily during their morning assembly programme.
Stating that Article 51(A)(a) of the Indian Constitution casts a duty on every Indian citizen to abide by the Indian Constitution and respect the ideals, the petitioner said that despite being very well aware of its importance, authorities have not taken adequate measures to implement the same.
Hence, he prayed to the court to direct all private schools coming under the control of Tamil Nadu to mandatorily facilitate playing/singing of the national anthem during morning assembly and include in the affiliated bylaws of CBSE the provision regarding mandatory facilitation of singing or playing the national anthem.
