HC directive to UP govt on DGP extension

The Allahabad High Court today directed the Uttar Pradesh government to file a copy of the letter through which it sought extension for DGP A K Jain.
A division bench of Justice Dinesh Maheshwari and Justice Ritu Raj Awasthi passed the order on a PIL filed by journalist J N Shukla seeking direction to the government to withdraw its order, if any, whereby Jain's term has been extended.
The petitioner alleged that Jain's extension was bad in the eyes of the law as inquiry of a criminal case against him and others has been completed and sanction for prosecution has sought from government by state CB-CID.
On behalf of the state government, Additional Advocate General Bulbul Godiyal contended that since some major works were being done in police department under Jain's supervision, his six-month extension was sought against which three months have been granted by the Centre, as per relevant rules.
She also questioned the locus standi of the petitioner for filing the PIL.
The court, while permitting the petitioner to make Jain a party in the PIL, sought a copy of the letter of the state government seeking permission for the DGP's extension.
It fixed April 9 as the next date of hearing.
