HC directs government to provide job to deceased worker's son

Madurai bench of the Madras High court has directed the Tamil Nadu Government to provide a suitable job for a deceased government employee's younger son, whose plea was rejected on the ground his elder brother was employed in Dubai.
Justice R Mahadevan allowing a petition by Arulamudham of Kanyakumari district who has been knocking at the doors of various authorities since 1993 for the job on compassionate ground after his father's demise.
Directing the government to provide the job within 12 weeks, the Judge said one should not presume that a person employed in foreign country was leading a comfortable and luxurious life without ascertaining the nature of the job and pay package associated with it.
"Except the NRI no body knows whether he has a white-collar job or menial job," he said.
Besides, the Judge, referring to the deportation of thousands of migrant workers from Saudi Arabia, said "This substantiates the conclusion that a job abroad need not necessarily mean that the employee and his family are not living in indigent circumstances."
"Another aspect is the marital status, if the elder brother was married, it would be construed as a separate family. Therefore, the authorities could not deny job to an individual by citing economic status of his married elder brother", he said.
