HC directs Govt Pleader to file proper affidavit

The Madras High Court today directed Tamil Nadu Government Pleader to file a proper affidavit with regard to a PIL which sought a halt to illegal use of banned plastic carry bags.
The first bench, comprising Chief Justice Sanjay Kishan Kaul and Justice M.Sathyanarayanan before whom the PIL by advocate Akila came up for hearing, granted three weeks time to file the proper affidavit after the petitioner contended the reply already filed was inadequate.
The petitioner submitted that even though the state government had banned use and sale of plastic bags in the city, all shops and commercial establishments continued to use them.
Even though the authorities were aware of the illegal sale of plastic carry bags, they have not bothered to prevent it. Hence, she sought a direction to the authorities to immediately take all preventive steps and to prosecute the offenders who indulged in illegal sale of plastic Bags.
The sale of plastic bags, which cause severe damage to the environment and block rain water from recharging underground water table, if not prevented with iron hands, will not only deplete underground water resources but also cause death and severe physical damage to live stocks, she said.
When the matter came up for hearing today, a copy of the affidavit filed by the government was given to her but it did not answer her specific queries, the petitioner submitted.
Following this, the court directed the Government Pleader to file a proper affidavit within three weeks.
