HC directs Registrar General to take necessary action
Press Trust of India Chennai The Madras High Court today directed Registrar General of Madras High Court to obtain information of pendency and disposal position with regard to the cases pending in districts for formation of Special Courts under section 14 of SC/ST (Prevention of Atrocities) Act and protection of Civil Rights.
A PIL was filed by A Narayanan seeking a direction to the Central and State Governments, to establish Exclusive Special Courts for for speedy trial in the Atrocity Prone Areas designated by the Government.
In the counter affidavit, Tamil Nadu Speciala Secretary Apurva Varma stated that for constitution of Special Courts in other atrocity prone districts including Cuddalore, Dharmapuri and other five Districts based on the pendency of cases would be send by Registrar General to the Government and the Government would pursue constitution of Special Courts on Such recommendations being received.
The First Bench comprising Chief Justice Sanjay Kishan Kaul and Justice T S Sivagnanam after perusing the affidavit in its order said "in view of the submission made by the Principle Secretary, the Registrar General may obtain requisite information of pendency and disposal position and the other atrocity-prone districts and thereafter make necessary recommendations, if the constitution of Courts is so required as per the parameters.
The Registrar-General to take necessary action within three months, and in case the recommendations is made the State Government would take expeditious steps.
