HC directs SDMC to take action against 24 properties in Sainik

The Delhi High Court today directed the South Delhi Municipal Corporation to take action against the 24 properties in Sainik Farms here which according to the city government show structural changes despite a court order banning the entry of construction material in that area.
"If there was a ban on entry of construction material, how are there changes in these buildings?," a bench of justices Badar Durrez Ahmed and Siddharth Mridul asked South Delhi Municipal Corporation (SDMC) and directed it to take action against these properties in accordance with law.
The bench also directed SDMC to file its status report of the action taken against the 24 properties before the next date of hearing on November 8.

It also issued notices to all the parties in the matter on the impleadment application filed by a society representing of Sainik Farm's original allottees - former Army personnel.
The society, which represents around 45 former army officers who are original allottees and have residences there, has contended that they can't be held accountable for any new constructions in that area which are unauthorised.
It also submitted that its members have not carried out any unauthorised construction.

The bench asked Additional Solicitor General (ASG) Sanjay Jain to file an affidavit indicating the position of the Centre on the issue of unauthorised construction in Sainik Farms.

It also asked the ASG to examine whether there can be a demarcation between the original allottees and the people who came in later.
During the brief hearing, Delhi government, represented by advocate Zubeda Begum, submitted it has identified from satellite imagery 24 properties in Sainik Farms which show changes.
