HC dismisses anticipatory bail plea of Firoz

Kerala High Court today dismissed the anticipatory bail application of A Firoz, suspended Director of the Public Relations Department and an accused in a cheating case registered in connection with the solar scam.
Dismissing the petition, Justice S S Sateeshchandran said no serious probe followed after Firoz was booked in the cheating case with solar scam accused -- Biju Radhakrishnan and Saritha Nair.
Firoz is the third accused in the cheating case filed by one Salim in 2009. The case relates to alleged swindling of Rs 40.2 lakh by the trio from the complainant.
Perusing the case diary, the court found that the investigating officials had gathered 'incriminating material' against Firoz. The court asked him to surrender before investigating officers by 10 AM on July 20.
The court held that no meaningful and effective steps had been taken to proceed against the petitioner after he was implicated as accused in the cheating case.
Government stated that the petitioner is an accused in a crime involving grave offences by a report dated Nov 25, 2010.
The court said it is "disturbing" that no action had been taken on such a report. "Perhaps, but for registration of the solar case, nothing tangible would have followed in the investigation of the present crime also," the judge held.
The court had earlier asked the prosecution why Firoz had not been arrested so far, especially when he was undergoing treatment in a hospital after registration of the case.
