HC dismisses appeal against order allowing 'Mersal' release

The Madras High Court today dismissed an appeal against a single judge order allowing release of the Tamil movie "Mersal", starring Vijay, on October 18.
The single judge had earlier restrained the producers of the movie from using the word "Mersal" in its title on a civil suit filed last month.
The suit was filed by A Rajendran of 'Film Factori' who submitted that he had commenced production of his movie "Mersalaitan" in August last year, but was shocked to note that there was another film titled "Mersal".
Dismissing the original application arising out of the suit on October 6, Justice Anitha Sumanth had vacated the interim injunction and held that the entire case of the applicant was based on the premise of probabilities and assumptions to clear the decks for the movie's release.
Rajendran moved the court against the order.
When the appeal came up, a division bench, comprising Justice Rajiv Shakder and Justice N Sathishkumar, said "... There is no error of law of fact in the impugned order of the single judge."
"The appellant court, if at all, can interfere on a principle of law and not because it may have a different view of the matter. For all these reasons, we find no merit in the appeal and dismiss the same," it said.
