HC dismisses ex-MLA's petition

The Lucknow Bench comprising Justice Abdul Mateen and Justice Devendra Kumar Upadhyaya, rejecting the petition, said no interference in the instant writ petition was called for by the court.

"We are of the considered opinion that the petition is nothing but an attempt to scuttle the investigation being conducted by the CBI under the direction issued by this court as affirmed by the apex court.

"Hence, no interference in the instant writ petition is called for by this court," the Bench said.

"Accordingly, the writ petition is dismissed," it said.

Last year, Samrite had filed a writ petition against Congress general secretary Rahul Gandhi in the Lucknow Bench which was dismissed by the court on March 7.

The Bench also slapped a heavy fine on the former SP MLA.

The court directed the CBI to lodge a case against Samrite and initiate legal process.

As per the court order the CBI lodged an FIR against Samrite on March 11, 2011.

The Supreme Court had on October 18 slapped a Rs 5 lakh fine on the ex-MLA while dismissing as without substance his petition against Rahul Gandhi in which he had alleged the the Congress leader had confined a girl in Uttar Pradesh.

"The allegation is without substance and without an iota of evidence," the Bench of justices B S Chauhan and Swatanter Kumar had said.
