HC dismisses petition

The Madras High Court has dismissed a criminal petition filed by one J Mohanraj seeking a direction to police to register a case on a complaint given by him against Tamil Nadu Cricket Association.
The petitioner alleged TNCA was functioning on a leased government land of 312 grounds for a lease amount of Rs.50,000 per annum and secured a stability certificate from PWD in 2008 but the next year wrote to the Collector seeking permission to demolish the stadium as it has outlived its purpose with the structure becoming weak.
He alleged that after obtaining the stability certificate, TNCA conducted the IPL matches the next year, following which he complained to the Commissioner of Police and the Deputy Commissioner about TNCA "cheating" the government to its own convenience. As no action was taken, he sought a direction to register a case on his complaints.
Dismissing the petition, Justice KBK Vasuki said the petitioner on the same basis filed a writ petition with a prayer to forebear TNCA from conducting any cricket events at the M.A. Chidambaram Cricket Stadium, Chepauk, until the stadium was fully reconstructed and safety ensured.
The petition was disposed of on the strength of the structural stability certificate issued by Public Works Department to the effect that "the stadium is sound except the areas in 'A''B' and 'C' blocks and is newly-constructed and as the stability certificate was also produced before this Court, issued by Superintendent Engineer and on the strength of the Certificate, the writ petition was dismissed."
"The petitioner appears to have not taken the question of correctness of the certificate issued by PWD and the order passed by this court on the strength of such certificate by way of writ appeal. Further, the petitioner has come up with the present complaint on the same set of allegations as raised in the writ petition which was already dismissed. In view of the same, the present complaint cannot be entertained and hence dismissed," the judge said.
