HC dismisses PIL seeking CBI probe against medical college

The Delhi High Court today dismissed a PIL seeking reliefs including a CBI probe into the admission process of Ghaziabad-based Santosh Medical College.
The PIL had also sought a direction to Medical Council of India to strike off the name of one Renuka Gautam from the medical register.
"Though the petition purports to raise the issue of private medical colleges admitting students who are not eligible for admission to the MBBS course but a reading of the petition leaves no manner of doubt that the same is directed primarily against Santosh Medical College and respondent no.5 Ms Renuka Gautam.
"Such a petition filed in public interest and targeted at a particular person always invites suspicion," a bench of Chief Justice G Rohini and Justice R S Endlaw said.

Citing apex court judgements, Justice Endlaw, writing the verdict for the bench, said "when a particular person is the object and target of a petition styled as PIL, the court has to be careful to see whether the attack in the guise of public interest is really intended to unleash a private vendetta, personal grouse or some other malafide object."
The judgement came on the PIL filed by Niloo Ranjan Kumar, an investigative journalist of a Hindi daily.

He had sought a direction to CBI to probe the admission process of Santosh Medical College and appointment of a committee to supervise the admission process there.

The PIL had also sought de-recognition of the medical college.
The court said the petitioner failed to provide any document in support of his claim as to why he wanted a CBI probe against the student and the college.
It referred to allegations and counter allegations levelled during earlier hearing that the petitioner demanded money for not filing the PIL and in fact, it was the college which offered the money respectively.
"We need not go into the controversy any further. The same is enough for not entertaining this petition and for dismissing the same. Dismissed. The petitioner to in any future PIL filed by him annex a copy of this order," it said.
