HC dismisses plea of ex-UP minister in cheque bounce case

The order was passed by Justice Manoj Mishra on a criminal writ petition of Nandi against whom a local trader Amar Nath Vaish had filed a case alleging that the senior BSP leader, who was at that time holding a cabinet berth, had issued a cheque of Rs 1.5 lakh in 2008 after purchasing cement from him but the same was "returned by the bank with the endorsement that the fund is insufficient".

Nandi had earlier moved a petition challenging criminal proceedings initiated against him by the lower court but it was was rejected by the high court on June 1 when it also directed the magistrate concerned to "consider and decide" the case "expeditiously, strictly in accordance with law, without granting unnecessary adjournment to either of the parties".

A bailable warrant was issued against Nandi by the magistrate after he failed to appear before the court despite issuing of summons.

The former minister thereafter challenged the warrant before the Sessions Court but the same was rejected on July 17 last following which he moved the High Court.

Nandi, an Allahabad-based industrialist, had made his political debut in 2007 assembly elections which also saw the Mayawati-led Bahujan Samaj Party assuming power in the state.

He was inducted into the cabinet and given the key portfolios of institutional finance and stamp and judicial tax.
