The Madras High Court has disposed of an application by a film production company seeking to restrain Director-Producer Gautham Vasudev Menon from releasing his Tamil film "Tamil Selvanum Thaniyar Anjalum" in view of pendency of a civil suit filed by it in relation to another film.
Justice K. Ravichandra Baabu in his order directed Menon and Photon Kathas Production Limited here to file a written statement within four weeks and go for the trial and establish their respective claims in the suit.
R S Infortainment Private Limited had filed the suit in 2013 claiming damages of more than Rs.10.50 crores from Menon and Photon Production for allegedly violating certain agreements signed with it for producing a Tamil film at a cost of Rs 13.27 crore and thereby resulting in the film not making any profit.
It contended that as per the agreement, the film was to be shot abroad and A R Rahman proposed as the music director but Menon engaged Ilayaraja and the entire film shooting was done within the country. Hence, it did not do well.
In the meantime, Goutham Menon produced "Tamil Selvanum Thaniyar Anjalum" which is ready to be screened. Hence R.S. Infotainment filed the present application seeking to restrain him from releasing the film without giving security of the suit claim.
In his order, the Judge said he was disposing of the application in view of the undertaking given by the counsel for Menon and Photon Production that a written statement would be filed within four weeks.
The Judge made it clear that the application was disposed of without expressing any view on the merits and contentions raised by the respective parties.
