Delhi High Court today extended till July the interim protection from arrest granted to AAP MLA Jarnail Singh who has been accused of assaulting an MCD engineer and preventing him from demolishing an illegal construction in West Delhi.
Justice Sunita Gupta also directed that police protection be given to the MCD engineer as and when required, after Additional Solicitor General (ASG) Sanjay Jain said due to the influence exercised by Singh, an Aam Aadmi Party MLA, the complainant official was not cooperating with the probe.
The court also directed the legislator "not to contact, coerce, threaten or influence the complainant in any manner" and listed the matter for further hearing on July 9.
While extending Singh's interim protection, the court also directed the investigating officer to send the mobile phones of the MLA and his supporter, Amarjeet Singh, to forensic science laboratory (FSL) within three days and asked its Director to expedite the results of the forensic analysis.
It also directed FSL to retrieve from Amarjeet's phone the recording he had made of the incident which he had subsequently deleted.
The court's directions came on the plea of the MLA from Tilak Nagar constituency who had moved the high court after the trial court had on May 2 refused him anticipatory bail.
The MLA has been booked for allegedly assaulting Athar Mustaffa, the MCD official, and preventing him from carrying out his duty when the latter and his team had gone to demolish an illegal construction in West Delhi area on April 28.
An FIR was lodged after the police received a complaint from the engineer.
