HC extends stay on ban of 25 food items in plastic packaging

Himachal Pradesh High Court today extended the stay on state government's notification issued on June 26, banning 25 food items in plastic packaging upto November 19, granting time to the Centre to file its reply.
The state government had banned junk food items like chips, biscuits and others in plastic or non-biodegradable packaging from sale and stocking with effect from July 1 after the High Court's orders.
The division bench comprising Justice Sanjay Karol and Justice Rajiv Sharma passed the order today on petitions of Sanyukt Vyapar Mandal Khalini, Indian Biscuits Manufacturers Association, NOIDA and Haroli Block Industries Associations, Tahliwal Una.
Earlier, on July 1, the High Court had stayed the notification till September 3, which expired today.
Passing the orders on January 10, the High Court had directed the government to ban the selling of food items in plastic packaging from April 1, 2013, but later extended the time limit to implement the orders for three months on state government's request, which cited far reaching consequences and impact on multiple stake holders, as reasons.
The government had said, additional time was required to evaluate the possible consequences that may arise as a result of ban on sale of food items with respect to relocation of workers, the status of loans obtained by local units, machinery, infrastructure and others.
The government had submitted that the ban's immediate impact will be directly on 6,000 workers employed in 270 local manufacturing units.
The time limit granted by the Court had expired on June 30 and the government went ahead with banning 25 food items in plastic packaging from July 1, 2013, which was extended upto September 3 and again upto November 19 today.
