HC finds fault with construction of juvenile homes

Finding fault with the delay in progress of construction of juvenile home at Madrurai, the Madras High Court today observed that "if this is the progress which would be maintained, one does not know when the completion of the project will see the light of the day."
After going through the compliance report by the officials, the First Bench comprising Chief Justice Sanjay Kishan Kaul and Justice T S Sivagnanam, on a writ petition regarding to Juvenile Home construction in their order said "almost after three months we find that the bar chart submitted shows that only the second stage is on the anvil of completion".
"This stage as per the bar chart itself required 25 days. We are of the view that from now on the bar chart has to be strictly adhered to by all concerned, whether it is the PWD or the other Government Authorities", the bench said.
"Thus while taking the Bar Chart on record, we direct strict adherence of them to on the assumption that we are at the beginning of third stage. On case of any unforeseen delay at any stage. The authorities would have to approach the the court for extension of time".
The matter relates to Juvenile Justice Homes in Tamil Nadu, which the First bench taken up suo motu writ on June 29, which it was informed by the state Government that no repair work was feasible and a new building has to be constructed.
Additional Advocate General P H Arvind Pandyan submitted that as for as the home at Thirunelveli is concerned, video conferencing facility will be made available and an approval for sanction of Rs.38,90,733 has been sent to Government on which the Bench directed that "we expect the necessary approvals within 30 days from the proposal being made and thereafter immediate steps should be taken for installation of the said facility."

The bench further directed the Member Secretary , Tamil Nadu State Legal Services Authority to consult with the Principal District Judge of Tiruchirappalli regarding issues pertaining to the Juvenile Home in that district and inform the bench on aspects to be addressed and what steps are further required for the development of the said Juvenile Home.
He also informed the court that a proposal has been sent to Government for Rs 91,72,771 for providing vehicles to all Government Child observations special Homes and approval is awaited.
The bench then directed the Government that all such sanctions shall be finalised within a month and posted the matter for further hearing to November 27.
