Justice Hima Kohli allowed 28-year-old Vikas Dagar to walk out of jail while allowing his plea for interim relief, sought on the ground that there is "no one in his family to look after his wife", admitted in hospital due to dengue.
The court, meanwhile, directed Dagar to furnish a bail of Rs 20,000 with two sureties of Rs 10,000 each of the like amount.
However, it made clear to his counsel that the sureties should be from the accused family or his close relatives.
In June this year, four persons were arrested for attack on Najafgarh MLA Bharat Singh.

Police had said that the accused Dagar planned the murder as he feared a backlash from the MLA, who he had slapped for humiliating his relatives in June last year.
On June 1, 2013 a Special Cell team had arrested the four accused from Kishangarh area when they came there to collect money for escaping to Rajasthan.
Dagar was arrested along with Kuldeep Mittal (26) and Sumeet Singh (28) of his village and Virender Sehrawat alias Bhola (23) of Deenpur area.
