HC lifts stay on Chhattisgarh's new reservation policy

A Division Bench of Justices Abhay Manohar Sapre and G Minhajuddin here heard the matter and lifted the stay on the quota policy it had granted in April, sources said.

However, the Bench maintained that all the appointments made under the policy will be subject to the court's final verdict on the matter.

On January 18, 2012, the state government had issued an order related to reservation in government jobs and educational institutes.

As per the order, the reservation for Scheduled Caste was reduced to 12 from 16 per cent and that for Scheduled Tribes was increased to 32 per cent. The quota for Other Backward Classes was maintained at 14 per cent.

Four separate petitions were filed in the court challenging the Government's order, which they said, was "unconstitutional".

The petitioners argued that under the new policy, reservation was touching 58 per cent when it should not exceed more than 50 per cent as per a Supreme Court's order.

After a preliminary hearing, the High Court had stayed execution of the reservation order.
