A division bench headed by Justice G K Vyas issued notice to the state government seeking its reply on the petition by September 2.
The quota agitation leader had moved the petition yesterday to seek relief from the "strict and unwarranted vigil" by the police, which he alleged, has set up a makeshift camp outside his temporary house for 6 months.
In his petition, Patel said that he has been temporarily staying in Udaipur for past one month but the police have "illegally" detained him in the house and was not allowing him to go anywhere.
He said that he has been held hostage by Udaipur police, while the order of Gujarat High Court did not mention anywhere that he would be kept under house-arrest.
