HC order issuance of bailable warrant to Housing Board

The Madras High Court directed its Registry to issue bailable warrant against Bhoopathy, Executive Engineer, Tamil Nadu Housing Board and instructed to secure and produce him before the Court on March 16.
Justice M S Ramesh, while issuing the order on a contempt petition, also directed the Registry to send the copy of the order to the Deputy Commissioner of Police, Anna Nagar here.
The matter relates to an order passed by the High Court on the allotment of a plot in Anna Nagar to S Chellaiah, following which he had paid Rs 14,050 towards the one third cost of the plot as demanded by the Housing Board on December five, 1998.
Subsequently the Housing board cancelled 139 allotments in the area citing some public purpose.
The allotters then moved the high court and got a favourable order from it.
When Chellaiah approached the board for getting the same benefit given to others, the board rejected it stating that he was not a party to the High Court order, following which he filed a separate writ petition.

The court on November 10, 2016 said that Chellaiah was also entitled for the benefit as granted by it for the other allottees and directed the Chairman of the board to inform the him about the balance of sale consideration payable for the allotment of the plot within two weeks.
As the authorities failed to obey the order, he filed a contempt petition following which the court had in last year issued statutory notice to Boopathy for his appearance before the court.
As he did not appear before the Court, the Judge ordered issuance of bailable warrant against the official.
