HC orders CBI probe into murder over land grabbing

The Madurai bench of Madras High Court today ordered a CBI investigation into the killing of Managing Trustee of a trust in Kodaikanal after he was allegedly kidnapped and forced to execute transfer deeds of some property in August last.
Passing interim orders on a petition by the wife of the deceased K Jamal Mohammed, Managing Trustee of K.M. Allaudin Rowther Dharma Trust", and eight others seeking CBI probe, Justice N Kirubakaran held that the present investigation by city police was not properly done.
"There is an improper, irresponsible, unfair investigation. It appears that investigation is not done as per statutory provisions and it appears mala fide," he said.
The judge directed CBI to appoint an officer in the rank of DSP to investigate and file a report within 12 weeks before the competent court and also compliance report before this court.
The judge observed that real estate business was a grey area wherein criminals, some officials and powerful persons were having big business and in the last 10-15 years, many murders and kidnappings had taken place.
He impleaded Inspector General of Police (Intelligence), and asked the Tamil Nadu Home Secretary, the DGP, the IG South Zone and the IG (Intelligence) to file a report on how many crimes were committed in connection with real estate transaction in the last ten years.
According to the petitioners, Mohammed went missing on August 31, 2014. Though his family informed police about a previous enmity between a group of persons who allegedly encroached on a portion of trust property and Mohammed, police did not take steps to trace him.

Police later said the body of Mohammed was found at Perumal Malai in Kodaikanal.
The city police did not take steps for a proper investigation, though it was stated Mohammed was abducted, and putting in fear of death, he was made to execute four property documents before a Sub-Registrar here.
The petitioners alleged that the police were trying to help the accused. It was only after they filed a case in this court that did police take some action.
