Justice M S Ramesh in his order yesterday said said ADGP of CB-CID had pointedout about the lapses of police officials in the death "Nambu Suresh" by keeping in "illegal" custody of him in connection with the missing of two kg of gold he was carrying without even registering a case.
The fundamental right had been violated in his case and the petitioner, Gayathri, wife of Suresh and her two children were right in filing the case seeking the compensation in the High Court directly.
The Judge ordered that the Tamil Nadu Public Secretary should pay the compensation amount in six weeks and the amout should be recovered from the Police personnel concered of Melur Police Station.
There was proof for the deceased being summoned to the police station and he was illtreated and subsequently he died.
He was summoned on May 10, 2010 for investigation. His relatives told the Melur police station officials that he had been admitted to hospital on the night of that day and then they were told that he had died.
