HC orders filing report on cops harassing bailiff

Madras High Court Bench here today directed the City Police Commissioner to file a report on a complaint that three police personnel, including an Inspector, detained a court bailiff and prevented him from discharging his duty in a civil case.
Justice R Subbiah directed the Police Commissioner to file a report on April 25, on the petition by one A Amalraj.
The petitioner submitted that Inspector Mannavan and Special Sub-Inspectors Martin and Alagumuthu had restored possession of a shop owned by him to his tenant shortly after the bailiff sealed it on the orders of the District Munsif Court on a plea by him.
He alleged that after the sealing process was over, Martin came there and snatched the shop's key from the bailiff and took him to the police station where he was detained for nearly five hours.
Despite the Senior Bailiff explaining that he only executed the court order, the Inspector and the SSIs abused him and forced him to hand over the key to the tenant.
The petitioner contended that their action amounted to interfering with the due course of judicial proceedings and defying the authority of law deliberately.
A representation narrating the details was sent to the Commissioner of Police on April 16, 2014, but no action had been taken, the petitioner said and prayed for a direction for appropriate action against the officers.
