The Madras High Court bench here today ordered issue of notice to Tirunelveli District Collector on a petition seeking to direct the Collector to allot alternative building to the Judicial Department for accomodating the Additional Sub Court and Additional Munsiff court at Tenkasi in this town.
The petitioner M Nathadu Bava submitted that he had leased his building to the court and lease expired on November 22, 2013.
He submitted that when he gave a representation to the Tirunelveli Principal District Judge and the Portfolio Judge of the Madras High Court to vacate the premises as the property had been subjected to partition, the PDJ said that he issued a communication to the District Collector to allot the Old Taluk Office Building in Tenkasi to the Judicial department for accomodating the court.
Though the letter was written on Septeber, 17, 2014, the Collector had been turning down to the request. Occupying the building without sanction of law was violative of his right to property, he contended.
Justices V Ramasubramanian and N Kirubakaran ordered issue of notice to the Tirunelveli District Collector returnable within three weeks.
