Justice T S Sivagnanam, on a petition by the father of girl who was gang raped by unidentifed persons on December 25 last year, in his order observed "it is seen that the investigation is not proceeding in the right direction. The relevant IPC provisions have not been included in the FIR and there has been gross violation of the relevant provisions of Protection of Children from Sexual Offences Act-2012"
The case relates to gang rape of the girl after beating her in the head with a log by the gang. She was admitted to a hospital at Denkanikotta. She later identified the four persons involved in the crime.
When the father of the girl went to the All Women Police Station to give complaint, they refused to take complaint citing absence of an Inspector of Police and only an entry was made that the girl was admitted in the hospital.
There the Girl was subjected to harassment by police officials. In the mean time the heads of four villages of surrounding area has ex-communicated the family of the victim girl for not settling the issue.
Hence the father of the girl approached the High Court with a prayer to transfer the investigation on both gang rape and ex-communication of his family to the CBI.
