HC orders medical examination of detenu

The Madras High Court today ordered medical examination of a person who was detained under Goonda's Act as he is suffering from brain tumor.
A division bench, comprising M Jaichandren and Justice Aruna Jagadeesan, considering a habeas corpus petition (HCP) filed by wife of the detenue, in its interim order directed the dean of Mahatma Gandhi Government Hospital in Tiruchiraappalli to depute a neuro surgeon to verify if K S Ramesh Babu was suffering from brain tumour as claimed by his wife.
The bench also directed the Dean to assess the general health condition of the detenue and file a report to the Court by March 16.
In her petition, R Tamilselvi submitted that her husband is the owner of three trucks which were rented out to sand quarries and government work. Because of heavy competition, there was business rivalry between truck owners and a case was foisted on him by Avudayar Koil police last year for offences punishable under Section 147 (Rioting), 341 (wrongful restraint), 379 (theft)and 506(ii) (criminal intimidation) of IPC.
After two more cases of similar nature were registered against him by the police, he was detained under Goonda's Act on November 17, 2014, she submitted.
She said though her husband was attacked and hospitalised, a third case was foisted against him and was arrested.
Though it was informed to the authorities that he is suffering from brain tumor and a representation too was given to them on November 25, 2014 a detention order under Goonda's act was passed against her husband.
She submitted that cases were foisted because of the business rivalry at the instance of competitors in the business. She prayed for quashing of the detention orders passed by the District Collector, Pudukkottai District.
He is in central prison at Tiruchirappalli since his detention.
