HC orders notices to TNHB; Secy, TN Housing dept

The Madras High Court today ordered issue of notices to Tamil Nadu Housing Board and Secretary, State Housing and Urban Development Department on a petition seeking a direction to quash a resolution passed by the Board deciding to sell 7.44 acres to an Educational Institution.
In an interim order, Justice V Ramasubramanian made it clear that any activity that Sri Ramachandra Educational and Health Trust carries on the land which was sold by Tamil Nadu Housing Board to it will be at their own risk and cost and will not confer any right upon them until further orders of the High Court.
Passing the interim order while admitting a petition filed by Advocate T Kalaimani of Thiruvanmiyur in Chennai, the judge also directed to submit all the records relating to the issue within eight weeks.
The petitioner prayed to quash the resolution dated July 1 passed by The Chairman, Tamil Nadu Housing Board, and the Managing Director of TNHB deciding to sell an extent of 7.44 acres at Thiruvanmiyur.
Kalaimani in his petition alleged that the land which costs Rs.3 crore was sold by passing a resolution to Sri Ramachandra Educational and Health care Trust for a meagre Rs 6,01,320 per ground causing a huge financial loss to the state.
He claimed that the land was acquired by TNHB to provide housing plots to the middle and lower income group people.
He said the resolution passed by the Housing Board authorities was illegal and arbitrary and prayed to quash the resolution and consequent sale of the land to the institution. He also sought an interim injunction restraining the educational institution from putting up any permanent constructions in the land in question.
The judge made it that if the educational institution carries on any activity, they cannot claim equity at the end of the day.
