HC orders sealing of unauthorised constructions in Delhi

The Delhi High Court today directed municipal authorities to seal all unauthorised constructions in a South Delhi colony where no sanction has been obtained.
A bench of justice Pradeep Nandrajog and Jayant Nath also ordered the South Delhi Municipal Corporation (SDMC) to submit a status report indicating the unauthorised constructions at Budh Vihar (Tajpur Pahari) colony here along with the date of proposed demolition of the illegal structures.
The court further directed SDMC to state in its report the date on which the authority had passed orders to seal the unauthorised constructions and the date on which they were sealed and listed the matter for further hearing on April 16.
The status report will also contain a list of the constructions sealed in furtherance of the court's order, it said.
The order was passed on the plea of Vijay Kumar Diwakar, filed through advocate Rajiv Kumar Ghawana, claiming that the unauthorised constructions are being carried out on government land without any sanction.
In his plea, Diwakar contended that the government had provided protection to all unauthorised constructions up to February 8, 2007, but the illegal constructions are still going on unabated.
He has alleged that despite repeated representations to the civic authority, no action has been taken till date.
In its defence, SDMC contended before the court that action is being taken to prevent and demolish the unauthorised constructions being carried out within its jurisdiction.
