"Reading the passage in complaint does not disclose any allegation against the (then) Chief Minister. As no allegation against the Chief Minister is instituted, prosecution by Public Prosecutor is not maintainable. Hence, the petition is allowed," said Justice R.S. Ramanathan before whom the petition filed by Ramadoss came up.
The Public Prosecutor at the District and Sessions Court at Villupuram filed the case against Ramadoss on behalf of Jayalalithaa for giving the interview on April 27, 2013 at Thailapuram, Villupuram district, on the murder of two Vanniyar youths at Marakkanam.
Ramadoss challenged this in court.
Counsel for Ramadoss argued that the averments in the complaint were not defamatory and that the complaint was totally misconceived and liable to quashed.
