The bench of justices Ajit Singh and Sanjay Yadav had reserved yesterday its judgement on the petition filed by Congress leader Mahesh Sahu.
Sahu had alleged that JP Associates, a firm, had purchased dumpers in the name of Chouhan's wife Sadhna, and deployed them in the service of its own company on rental basis, which benefited the chief minister.
The company paid the margin money for financing the dumpers and they (Chouhans) furnished wrong affidavits and addresses in the papers, Sahu had said.
Calling the petition as "baseless", the bench said the closure report had been filed after the approval of state Lokayukta, who is a retired Supreme Court judge, and it was accepted by the special court. Therefore, it was not proper to demand CBI probe without solid grounds.
The court also pointed out that actual price of the dumpers was Rs 73,70,439, and their margin money for the loan purpose was Rs 7,38,740, as against the petitioner's claim that cost of the vehicles was Rs 2 crore.
The margin money too was returned by Sadhna to the company in two instalments, the court noted.

Regarding the issue of wrong address, the court said there is a provision in the Motor Vehicles Act that in the case of commercial vehicles, the local address where the vehicle is deployed should be given to the RTO.
The Lokayukta had submitted the closure report on the complaint against Chouhans on December 29, 2010, which was accepted by the lower court.
Sahu then moved the high court. (More)
