HC reserves orders

Madras High Court today reserved orders on the petitions filed by Sun Group-owned Kal Cables Private Limited challenging the circular issued by the I & B Ministry cancelling the firm's permanent registration to operate as MSO under Digital Addressable System.
After hearing arguments submitted by Senior Counsel P.S.Raman and ARL Sunderasan for Kal Cables and G.Rajagopalan for Central Government,Justice V.Ramasubramanian reserved orders on two different pleas filed by Kal Cables.
The Additional Solicitor General, who submitted a confidential file to the court, in his arguments, wondered how a clean chit can be given to Kal Cables on the receipt of an adverse information from the Home Ministry against the management of the firm.
He submitted that the provisional license issued to them was subject to the security clearance from Home Department.
When the Home Department submitted a report and raised objection showing security reasons, which is pre-condition to grant the permanent license, I&B department cannot issue license, he submitted in his arguments.
Senior Counsel P.S.Raman argued that the pre-condition in the issue of license security Clearance relates only to a National Security which will not attract to the company or its Directors as they are not facing even an FIR.

He submitted it was only doing a cable tv network service which is nowhere connected with the security Clearance.
He further argued that they are governed only by the Cable Television Net Work Regulation Act and Rules,1994."Rule 11 (b) of the rules clearly mandates that within 30 days of submission of application for the license concerned authority should accept or reject the same by taking into consideration of all the factors including security clearance."
He submitted that there was not even a single criminal case against the Directors of the Company and questioned whether the Security Clearance is a pre-condition for the company or the persons in charge of the company.
He submitted that he did not know the contents in the confidential file submitted by the Additional Solicitor General. "Today I am answering to the allegations which are unknown to me.
