The Calcutta High Court today said it has no jurisdiction to interfere in a decision of Parliament that did not accept the findings of the Justice (retd) Manoj Mukherjee Commission on the disappearance of Netaji Subhas Chandra Bose.
A division bench comprising Justice Asim Kumar Banerjee and Justice M K Chaudhuri, disposing of the petition, said that as the decision was taken in Parliament, the court has no jurisdiction to interfere.
The Justice Mukherjee Commission was set up in 1999.
The report was placed before Parliament in May, 2006.
After a long debate, the House did not accept the findings of the commission.
This was challenged before the Calcutta High Court by one Rudra Jyoti Bhattacharya through a writ petition.
The division bench passed the order today.
