HC seeks CBI's response on fresh probe into death of alleged
Press Trust of India Lucknow The Allahabad high court today directed the CBI counsel to seek fresh instructions for placing its response on July 6 regarding the agency's probe into the death of an alleged HuJI terrorist who was also an accused in a case relating to serial blasts in the court premises in 2007.
A Lucknow bench, comprising justice Ajay Lamba and justice Akhtar Husain Khan, passed the order on a writ petition filed by Zaheer Alam Falahi and another seeking a direction for CBI investigation into the death of Khalid Mujahid in police custody on May 18, 2013, in Barabanki while being brought back to Lucknow from Faizabad after appearance in the court.
On behalf of the state government, Additional Advovate General Zafaryab Jilani told the court that "after investigation the police had filed final (closure) report. However, the state government has no objection if CBI conducts investigation of the case as the state government had already recommended its probe by CBI on May19, 2013".
According to petitioners counsel Amir Naquvi, CBI had refused investigation into this case for certain reasons and placed its response to this effect but the court has directed it to seek fresh instructions and placing its response on July 6 regarding CBI investigation in the case.
