HC sets aside order awarding compensation to medical student
Press Trust of India Madurai Madurai Bench of the Madras High Court today set aside the order of a Single Judge directing Tamil Nadu Health Secretary and two others to pay a compensation of Rs.One lakh and Rs.25,000 towards litigation cost for depriving a medical student a PG seat due to their "callousness and lethargic attitude".
Justice Sanjay Kishan Kaul and Justice Tamilvanan said the facts and circumstances of the case revealed that there was no callousness or negligence or lethargic attitude on the part of the officials.
"There is no malice or conscious abuse by the secretary of the Health Department or Secretary of the Selection Committee, Directorate of Medical education.Hence there is no need for awarding any damages to candidate Mercy Rumya Florence.
Allowing the appeal filed by the Secretary and others, the Judges said "It is crystal clear that there is no callous or negligence or lethargic attitude by the appellant officials.
