Justice T Vaiphei after hearing the case also quashed the connected departmental inquiries against Dr C S H N Murthy and pay him all the back wages from the date he was removed from service on November 8, 2013 within a period of three months.
Failing to pay his back wages, the petitioner shall be entitled to interest at 12 per cent per annum from the date of the judgement.
While the petitioner was discharging his duties in Tezpur University, the allegation of sexual harassment was levelled against him by some girl students of his department leading to an inquiry by the University's Complaint Committee on Sexual Harassment.
The Committee recommended termination of his service and accordingly departmental proceedings were initiated after placing him under suspension.
Justice Vaiphei, after hearing the case, elaborately discussed the facts and materials placed before the court and inter alia held that the inquiry proceeding initiated against Dr Murthy suffered from illegality, procedural impropriety and arbitrariness.
