HC slams regularisation of unauthorised constructions

Decrying the procedures adopted by authorities for regularisation of unauthorised constructions, Madras High Court today observed that the time has come for the state to review the statutory provisions in view of the rampant misuse.
The court noted that authorities allow constructions without any sanction and then allow the violators to file for regularisation of the same.
A bench comprising Chief Justice Sanjay Kishan Kaul and Justice T.S. Sivagnanam made the observations during the hearing of a petition by social activist "Traffic" K Ramaswamy.
Petitioner has sought action against officials for their misconduct and abuse of process of executive powers in allowing Sri Muthukumaran Educational Trust which had built a Medical College in contravention to the sanctioned Plan.
In its order, the Bench said "To our mind it is a matter of major concern that rampant unauthorised construction went on without even planning permission being obtained and post facto approval was sought."
Granting two months time to the trust to complete the building in conformity with a Government Order which directed demolition of unauthorized portions, the bench made it clear that it still deviation persists no impediment would be created for sealing the building in question.
The bench sought the stand of Medical Council of India in granting permission to the college and whether requisite precautions were taken by it before giving the nod.
It issued notice to counsel V.P.Raman for MCI to be present in the court on the next hearing on October 1 and directed the institution to file an affidavit.
