A bench headed by Justice Dilip B Bhosle directed the SP to be present in the court on June 18.
Petitioner Valli Ramanathan has challenged the "illegal detention" Nithyananda immediately after he was granted bail by a Ramanagar court on June 14.
Nithyananda was granted bail by court in the case registered against him recently for allegedly assaulting a regional TV reporter but was re-arrested the same day on charges of disturbing the peace.
Subsequently, he obtained bail from the executive magistrate yesterday.
Ramanathan, who heads the publication division of Nithyananda's ashram at Bidadi near here, contended that immediately after a judicial order was passed to release the self-styled godman on bail (on June 14) he was "whisked away by the police without even allowing him to have the benefit of the bail order".
"He was taken to the office of the Deputy Commissioner and there he was informed that he is being detained invoking section 107 and 151 CrPC," the petitioner said.

She further submitted if the police had an apprehension as contemplated in section 151 CrPC, nothing prevented them from reporting the same to the court.
"Possibly the Investigating Officer was under the impression that no bail would be granted but on bail being granted by judicial magistrate, to defeat a judicial order contemptuously he was taken to custody and was produced before the Deputy Commissioner who directed detention in Mysore", She charged in her petition.
