HC upholds constable's dismissal

The Madurai bench of the Madras High Court today upheld the dismissal of a police constable who was charged with molesting women, saying he was not at all "desirable to be a part of a disciplined force".
Dismissing the petition of M.Saravanakumar, who was working at the Manimuthar T.S.P IX Battalion, Justice R.Mahadevan, quoting the charges framed against him, said "they are highly reprehensible and unbecoming conduct of a police person."
He had entered the house of one Sudalaimuthu and attempted to molest his wife. Then he entered the house of another person and attempted to molest his wife also, the court said.
The commandant removed him from service after an inquiry. The DIG and the DGP also dismissed his appeal.
The Judge said the perusal of the preliminary report submitted by the Assistant Commandant of the TSP IX battalion would show there were several occasions on which the petitioner had committed the acts affecting moral turpitude.
The petitioner was not conscious of the fact that he was working for a disciplined force and had conducted himself in a manner that clearly emphasised his attitude towards the society.
"Such a kind of practice should be cut at its root. If the conduct of the petitioner is viewed lightly, then it would lead to a sorry state of affairs," the Judge said, upholding the dismissal.
