"To conclude, the entire case of the prosecution hinges on the testimonies of the two brothers of the deceased, one of whom is an injured witness. We find the testimonies of the witnesses worth of credence. The medical evidence further lends credence to the ocular testimonies," a bench of justices Reva Khetrapal and Sunita Gupta said.
The court also upheld the conviction of Sanjay for attempting to kill the two brothers of the victim as they had objected to her killing.
The accused, who was irked over the affair of his cousin with a boy in their neighbourhood despite the warning, stabbed his sister four times on the evening of August 31, 2004 in a locality here.
Rajesh and Raj Kumar, key eye witnesses and brothers of the victim, objected to the killing of their sister and one of them also received knife injuries in the process.
The court lent credence to the testimonies of brothers saying the plea that they had framed the accused was untenable as one of them also received injuries.
