Dismissing the appeal filed by Sagar against the trial court order, Justice S P Garg relied on the victim's statement and the test identification parade (TIP) report in which he had recognised the accused.
The court also accepted the recovery of weapons -- a country-made pistol and a knife -- and Rs 700 from the accused.
"The nature of injuries caused to the complainant with the weapon is enough to infer that it was a deadly one. In the light of above discussion... I find no merit in the appeal. The judgement is based upon fair appreciation of the evidence and needs no interference. The appeal is dismissed," the court said in a recent judgement.
They had also caused injuries to the victim while committing the offence, the prosecution said.
The trial court had discharged co-accused Allauddin due to lack of evidence, but on July 22, 2010, held Sagar guilty of the offences and sentenced him to seven years in jail.
