A division bench of Justice M Jaichandran and Justice M Venugopal in a more than 100-page judgement, approved the direction of a single judge to accommodate the institute's students of the academic year 2010-11 in government medical colleges in the state.
But the bench set aside the single judge's direction to MCI to accommodate the students of academic years 2011-12 and 2012-13 in government medical colleges by increasing the intake capacity of colleges in the academic year 2014-15.
The bench also upheld MCI's decision to permit the state government to encash the bank guarantee given by the College in Thiruvallur district and its decision to return the application received from the institute along with the fees for carrying out the assessment of the college for academic year 2014-15.
It set aside the MCI order to debar and blacklist the DD Medical College Educational Trust and its trustees permanently from making any application under the MCI Act 1956 for establishment of the Medical College.
On January 20, Justice K.K. Sasidharan directed the state government to redeploy or accommodate two batches of students of DD Medical College and Hospital in government medical colleges in the academic year 2014-15 and also asked the MCI to create additional seats in the colleges.
The MCI, in its appeal, contended that single judge order to accommodate the students of the institute in the academic year 2014-15 by creating additional seats in government medical colleges was 'patently illegal.' It also said the college admitted students without getting its approval and the students were cheated.
