"HEC Ltd, being the lawful owner of its property, has filed a complaint before the Court of Estate Officer... On October 12, 2015... Incorporating details of violations of the terms and conditions of the lease agreement and reasons/base for terminating the same (with the JSCA)," said a press release issued by the public sector unit.
The HEC pleaded with the court for issuance of an eviction order along with reserving its right to claim damages in due course, the release said, adding, being a Central Public Sector Unit, HEC filed the complaint under the Public Premises (Eviction of Unauthorised Occupant) Act 1971.
HEC had earlier issued an eviction notice to JSCA after it terminated the lease agreement between the two over violations of terms of the deal.
According to HEC release, it had allotted 31.7 acres to the JSCA for building a cricket complex/centre, a befitting venue for international matches in 2008 under the direction of the Jharkhand High Court.
Referring to the June 25, 2008, lease agreement for a 30-year period between HEC and JSCA, the release alleged violation of many terms and conditions by JSCA.
In spite of the fact that HEC pointed out these lapses on many occasions for rectification, JSCA did not heed to the notices it sent on April 10 and September 20, 2013, and January 16 this year before the lease deed was terminated on July 4, 2015, it said.
