High Court summons TN School Education Secretary

The Madras High Court has ordered Tamil Nadu School Education Secretary to appear in person and explain the inordinate delay in not implementing the court orders to pay arrears as per the fifth pay commission recommendations to some retired government school headmasters.
A division bench of the court here comprising justices Satish K Agnihotri and R Sudhakar yesterday ordered statutory notice to D Sabitha, state Education Secretary, to appear in a contempt of court petition filed by K Velusamy, a retired headmaster.
Velusamy contended that the official disobeyed court orders passed in 2011, though he represented to her on September 26 last year.
The judges rejected Special Government pleader's contention that the orders were not complied with as the School Education Department had decided to file a review petition before the court.
The judges said the official was bound to comply with the orders unless they had been set aside by a competent forum.
The petitioner's counsel said 12 retired headmasters had obtained orders from the court in 2011 to pay them special grade pay and selection grade pay introduced for the post of elementary school headmasters in accordance with fifth pay commission recommendations.
The education department had implemented the court orders in respect of five retired headmasters and did not implement for others for reasons not known, the counsel contended.
