An IPS officer facing criminal proceedings under Dowry Prohibition Act and Tamil Nadu Prohibition of Women Harassment Act has moved the Madras High Court seeking to quash the entire proceedings against him.
As an interim relief, Varun Kumar sought a stay on the proceedings of the case pending before the XI Metropolitan Magistrate Court at Saidape here and to dispense with his personal appearance during hearings in the trial court.
Justice M S Ramesh admitted his plea and ordered notice to Central Crime Branch Police, Chennai and passed an interim order dispensing with his personal appearance in the trial court.
In 2011, G Priyadarshini had lodged a complaint against Kumar, claiming that they had been friends since 2007 and he had promised to marry her.
However, after being selected for IPS in 2011, his attitude changed and he and his parents demanded two kg gold, Rs 50 lakh cash and a luxury car as dowry, she claimed.
Subsequently, a criminal case was registered against Varun by CCB. Varun in his petition submitted that the trial court had not applied its mind while framing charges and that the de facto complainant has foisted a complaint against him only with mala fide intention to harass him and wreak vengeance.
He said the court had failed to take into consideration that even according to the complaint there was no formal betrothal or engagement or even pre-engagement ceremony.
