Report accordingly be sent to this office without further delay," the DIG had written to the SSP Anantnag in response to the representation by Zaitoona. While disposing of the petition, Justice Masoodi said "there is nothing on file to show that the order of Deputy Inspector General of Police, SKR, Anantnag, has been carried out and matter entrusted to a Gazetted Officer." In the circumstances, Deputy Inspector General of Police, Anantnag, having taken cognisance of the matter and passed necessary instructions on August 9, 2011 for inquiry by a Gazetted Officer, respondents cannot be heard saying that the matter does not warrant any consideration because of delay, he said. The judge also observed that the interest of the State, as is borne out from the maxim "Interest reipublicae ut sit finis litium", is that there should be a limit to litigation. "However, in peculiar circumstances of the present case set out hereinafter, we are not required to dilate on this aspect of the case," he said. On the question of compensation, the court observed that compensation if any, to the petitioners would hinge on outcome of such inquiry.
