"The principal judge directed the magistrate to take action as per the law," defence lawyer Khalid Azmi said.
The accused had moved an application in the magistrate's court last month alleging that they were assaulted while they were in judicial custody, following which the accused were sent for medical examination which confirmed assault.
After the assault was medically confirmed, the magistrate forwarded the medical report and a copy of the complaint to principal judge Swapna Joshi, who is the in-charge of jails in her jurisdiction.
Additional metropolitan magistrate PS Rathod, who received the principal judge's direction, wrote to the chief metropolitan magistrate to assign the inquiry to another magistrate and expedite the process.
On August 11, protestors had attacked the police, including some women constables, torched media and police vehicles, as well as smashed cameras of journalists.
Among those arrested include two "most wanted" rioters, who had allegedly vandalised the iconic Amar Jawan memorial on the fateful day.
In all, the police arrested 60 accused in connection with the violence and charged all of them with Section 302 (Murder) of the Indian Penal Code, besides Arms Act and Prevention of Damage to Public Property Act.
